Islamic Legal Basis of Waqf

"When a person dies, their deeds come to an end except for three: ongoing charity (Sadaqah Jariyah), knowledge that is benefited from, and a righteous child who prays for them."
Prophet Muhammad ﷺ | Sahih Muslim 1631
"The example of those who spend their wealth in the way of Allah is like a seed of grain that sprouts seven spikes; in each spike there are a hundred grains."
Surah Al-Baqarah, Ayah 261

Waqf (Islamic endowment) is one of the most powerful instruments of Sadaqah Jariyah in Islamic jurisprudence. The Waqf of BTFHH is established and governed strictly according to classical Islamic fiqh — specifically the Hanafi school. Once an asset is declared Waqf, it becomes a permanent endowment: it cannot be sold, inherited, gifted, or repurposed outside its declared charitable purpose.

Waqf Process — Step by Step

01

Donor contacts BTFHH Waqf Office. Selects asset type (bed, cabin, OT, ICU, floor, or land). Asset availability confirmed by Waqf Administrator (Mutawalli). Donor identity verified with NID.

02

Waqf Deed prepared by the Islamic legal team — specifying asset identity, donor name, charitable purpose, and Shariah conditions. Deed reviewed by Shariah Board.

03

Individual fatwa issued per asset by a certified Hanafi scholar — confirming the Waqf is valid, irrevocable, and compliant with Bangladesh Waqf Administration.

04

Waqf Deed formally registered with Bangladesh Waqf Administration. Reference number issued. Legal protection activated.

05

Permanent nameplate installed on the dedicated asset — bearing donor or deceased loved one's name in English and Bengali.

06

Annual Waqf Utilization Report sent to each donor: patient count, treatment outcomes, and Sadaqah Jariyah continuity confirmation.
